Former NBA Star Dwight Howard Denies Sexual Assault and Battery Allegations

Former NBA star Dwight Howard has vehemently denied the sexual assault and battery allegations that were filed against him earlier this year. In court documents obtained by ESPN, Howard stated that the encounter in question involved “consensual sexual activity” with a man named Stephen Harper at Howard’s Georgia residence in July 2021. Additionally, he denied causing any injury to Harper, refuting the claims put forth in the original complaint.

Consent Controversy

While Howard maintained that the encounter was consensual, Harper’s lawyers maintained that their client did not provide consent. In response, Harper’s attorney, Olga Izmaylova, acknowledged that they expected Howard to argue the issue of consent in his response. However, they stressed that Harper’s complaint also included allegations of intentional infliction of emotional distress and false imprisonment, which Howard firmly denied.

Public vs. Private

According to one of Howard’s attorneys, Justin Bailey, the private encounter between the two parties became public due to a desire for profit. Bailey maintained that Howard intends to present the truth in a court of law, highlighting the fact that the allegations against Howard are contested. Furthermore, Bailey revealed that Howard had been faced with a difficult choice – pay to protect his reputation or have a fabricated story made public. Despite the challenges and scrutiny, Howard opted to trust in the justice system and will allow the court filings to speak for themselves.

To support his claims, Harper’s complaint included screenshots of alleged Instagram exchanges between him and Howard dating back to 2021. Additionally, an Uber receipt for Harper’s trip to Howard’s residence on the night of the encounter was included. However, it is important to note that Harper went to the police a year later, as indicated by a July 2022 incident report from the Gwinnett County Police Department. No charges were filed at that time.

According to Harper’s attorney, Izmaylova, there were independent investigations to conduct and private factors to consider before both parties felt ready to proceed with the lawsuit. In Georgia, the statute of limitations allows for the filing of such civil lawsuits within two years from the date of the incident. This timeframe allowed Harper and his legal team to thoroughly evaluate their options before initiating legal action.
